The conditions below regulate access to and use of the AMERIS HOTELS portal (www.amerishoteis.com.br) by the USER who accesses the page to obtain information and contract the services advertised on the portal. Before contracting, it is necessary for the USER to read these Terms of Contract and expressly accept them by “clicking” on the button at the end of the form (“I Agree to the Hotel’s Policies”). If the USER does not accept these Terms, they should refrain from contracting the services proposed by AMERIS HOTELS.

1. SUBJECT MATTER

These terms govern the use of the portal, as well as the booking of hotel reservation services, with the booking of a particular reservation subject to the specific terms and conditions established for each case.

By contracting the selected service, the USER agrees to accept and abide by these reservation terms and conditions, including compliance with any rules and restrictions regarding the availability of rates, products, or services.

2. CONTRACTING

After accepting these conditions, which are available for download and printing at the beginning of the contracting process, and selecting the desired service, the USER will have access to a page where they will be prompted to enter the personal data of the reservation holder. All collected data will be processed in accordance with the portal’s Privacy Policy. Subsequently, the necessary data for payment of the selected service will be requested, which will be made via credit card and through the payment gateway established for this purpose.

Booking reservations will be subject to the specific terms and conditions set by the suppliers or organizers of such products or services for each case, as established in the following clause.

The USER will give their consent by clicking the “Complete Reservation” button located at the bottom of the page where payment details are requested. Confirmation of the purchase by the service provider will always imply the perfection of the contract and the commitment by the customer to pay the established amounts. After their consent, a page confirming the purchase will be displayed on the screen, and an email with the associated purchase information will be sent to the customer.

3. PARTICULAR CONDITIONS

The conditions of each service, including, among others, prices, changes, cancellations, and other aspects not covered in this document, will be governed by the provisions established by the respective hotel establishments and may be subject to modifications for which AMERIS HOTELS, as a mere intermediary, assumes no obligation or responsibility.

These Particular Conditions will be considered accepted according to the provisions established in the previous clause. If these conditions do not allow changes or cancellations by the USER, they will not be entitled to a refund of the amount paid for the reservation to AMERIS HOTELS.

4. AMERIS HOTELS’ OBLIGATIONS

AMERIS HOTELS undertakes to:

a) make every effort to carry out the necessary procedures for the realization of the acquisition by the USER of the service they have contracted through the portal.

b) provide the USER with the necessary documents for them to enjoy the contracted service.

c) fulfill the other obligations set forth in these conditions, as well as in the conditions provided for in Clause Three.

5. USER’S OBLIGATIONS

The USER undertakes to:

a) pay the amounts corresponding to the contracted service, including taxes and fees.

b) take responsibility for the authenticity of the provided data, as well as ensuring their correspondence with their identity.

c) assume any responsibility arising from not possessing the necessary documentation to enjoy the contracted service and must inform themselves in advance about the requirements required in this regard.

d) fulfill the other obligations set forth in these conditions, as well as in the conditions provided for in Clause Three.

The USER also agrees to accept and abide by the terms and conditions of purchase established by any hotel the USER chooses to contract, including, but not limited to, the payment of any amounts due and compliance with any rules and restrictions regarding the availability of rates, products, or services. If there are special rules or restrictions that affect certain tasks, products, or services selected by the USER, such special rules or restrictions will be disclosed to the USER under the conditions before making the reservation.

6. RESPONSIBILITIES

The parties acknowledge that AMERIS HOTELS acts solely as an intermediary between service providers (hotels) and the USER. They also recognize that AMERIS HOTELS cannot guarantee the absolute continuity of the service, although it endeavors to prevent its interruption or malfunction. AMERIS HOTELS shall not be liable for any damage, loss, or harm suffered by the USER due to internet failures, system malfunctions, or server issues resulting from third-party conduct, force majeure, or unforeseeable circumstances. AMERIS HOTELS shall also not be responsible for any viruses that may infect the USER’s equipment because of internet access, usage, or browsing, or because of data, file, image, text, or audio transmission.

AMERIS HOTELS shall not be liable for the non-fulfillment of services offered through the portal by the respective service providers (hotels). If, due to force majeure, there are failures regarding reservations, confirmations, and/or the execution of any services contracted through AMERIS HOTELS, under circumstances that are unforeseeable or unsolvable by AMERIS HOTELS, the USER waives any claims against AMERIS HOTELS and/or the AMERIS HOTELS group companies, existing at present or in the future.

7. WAIVER OF HANDWRITTEN SIGNATURE

The USER waives the handwritten signature for any electronic transaction generated as a result of a reservation made through the portal, regarding any services offered.

8. ERROR CORRECTION

AMERIS HOTELS provides its customers with the email address contato@amerishoteis.com.br, to which they can send an email if they detect any errors regarding the data entered during the contracting process. In this regard, they will have 24 (twenty-four) hours to inform AMERIS HOTELS of this situation from the moment of purchase confirmation.

9. AMENDMENTS

AMERIS HOTELS may unilaterally amend these General Conditions whenever deemed necessary, as well as introduce new clauses, undertaking to communicate any changes to USERS in advance.

10. DATA PROTECTION

Any data processing resulting from the execution and compliance with these conditions will comply with the provisions established in the Privacy Policy, made available to the customer on the portal, which will be considered an integral part of these conditions.

11. SECURITY

The declaration of nullity of one or more clauses of these general conditions by a competent authority shall not affect the validity of the remaining clauses. In this case, AMERIS HOTELS undertakes to draft a new clause to replace the one that is annulled, which best suits the situation. If replacement is impossible and the clause is essential, if the injured party decides so, they may opt for contract termination.

12. JURISDICTION

These Conditions are governed by the laws of the Federative Republic of Brazil and by the Treaties and International Conventions to which Brazil is a signatory. The jurisdiction of the Courts of the district of the USER’s residence when residing and domiciled in Brazil is hereby elected. For other cases, they submit to the Courts of Brasília-DF, Brazil, with express waiver of any other, however privileged it may be or become, to settle any doubt, pending matter, or litigation.
